Why does Obama permit tobacco and cigarettes?

I believe the federal government and most states get over a dollar tax per pack. Not to mention, sad to say, but many life time smokers do not live long enough to collect SS or Medicare. Making it illegal would create another "war on" black market . And we are losing all the war on's we have now.
